Maison Lefon

These Terms of Service ("Terms") govern your use of maisonlefon.com (the "Site") and any purchase you make from us. By using the Site or placing an order, you accept these Terms. Please read them carefully.

1. Who we are

2. Our products

Maison Lefon offers lab-grown and pre-owned fine diamond jewelry. We take great care to describe and photograph each piece accurately, including, where applicable, gemological certificates (e.g. GIA, IGI) and the condition of new/pre-owned pieces.

Photographs are illustrative; natural variations in color, scale, and finish may occur, and screen settings can affect how colors appear. For pre-owned and one-of-a-kind pieces, minor signs of prior wear consistent with the stated condition do not constitute a defect. Stock is limited and certain pieces are unique; availability is not guaranteed until your order is confirmed.

3. Prices and taxes

All prices are shown in EUR and SEK and include applicable Swedish VAT for orders within the EU. Prices may change at any time, but changes do not affect orders already confirmed. Deliveries outside the EU may be subject to import duties and taxes, which are the customer's responsibility (see our Shipping Policy).

We make every effort to ensure prices are correct. In the event of an obvious pricing error, we reserve the right to cancel the affected order and refund any amount paid.

4. Orders and formation of contract

Your order constitutes an offer to purchase. A binding contract is formed when we confirm your order by dispatching it, or by sending a separate confirmation of dispatch. We reserve the right to refuse or cancel any order - for example due to unavailability, suspected fraud, or a pricing or product error - in which case any payment will be refunded.

5. Shipping and delivery

Dispatch and delivery are governed by our Shipping Policy, which forms part of these Terms. Risk for the goods passes to you upon delivery (or to a person you authorize to receive them).

6. Right of withdrawal (consumers)

If you are a consumer in the EU, you have a 14-day right of withdrawal under the Swedish Distance Contracts Act (lag (2005:59) om distansavtal och avtal utanför affärslokaler), counted from the day after you receive the item. The procedure, return conditions, and refund terms are set out in our Refund Policy, which forms part of these Terms.

The right of withdrawal does not apply to:

bespoke or made-to-order pieces produced to your specifications;
personalized pieces that have been engraved, resized, or otherwise individually adapted for you;
sealed earrings for pierced ears where the hygiene seal has been broken after delivery.

We will clearly indicate at checkout when an item is non-returnable for these reasons.

7. Faulty or incorrect goods (complaints)

Independently of the right of withdrawal, consumers have a three-year right of complaint (reklamationsrätt) for original defects under the Swedish Consumer Sales Act (konsumentköplagen 2022:260). Report any defect within a reasonable time - always within two months of discovering it. We will repair, replace, reduce the price, or refund as the law provides. 8. Statutory consumer rights

Nothing in these Terms limits or excludes the rights you have as a consumer under mandatory Swedish or EU law. Where any provision of these Terms conflicts with such rights, your statutory rights prevail.

9. Care and guarantees

Any voluntary guarantee we offer is stated with the relevant product and supplements, but does not replace, your statutory rights. Fine jewelry requires appropriate care; we are not liable for damage resulting from misuse, accident, or normal wear after delivery.

10. Intellectual property

All content on the Site - including the Maison Lefon name and logo, text, photography, design, and graphics - is owned by or licensed to us and is protected by intellectual property law. You may not copy, reproduce, or use it for commercial purposes without our prior written consent.

11. Acceptable use

You agree to use the Site lawfully and not to attempt to disrupt, misuse, or gain unauthorized access to it or to other users' data.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Site. Nothing in this clause limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law - including consumers' mandatory rights under clause 9.

13. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier disruptions, supply shortages, or other circumstances of force majeure.

14. Personal data

We process personal data in accordance with the GDPR and our Privacy Policy, which explains what we collect, why, and your rights.

15. Governing law and disputes

These Terms are governed by Swedish law. If a dispute arises, we will always try to resolve it with you directly - please contact us first. You may also seek free guidance from Hallå konsument (Konsumentverket) and refer a dispute to the Swedish National Board for Consumer Disputes, Allmänna reklamationsnämnden (ARN), arn.se, whose recommendations we follow. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
